§1 Scope

These T&Cs apply to all orders placed via our online shop. They apply to both consumers and entrepreneurs. A consumer is a person who buys something for private use. An entrepreneur is a person or company who buys for business purposes.

These terms and conditions also apply to future orders from entrepreneurs without us having to point this out again. We only accept conflicting terms and conditions of an entrepreneur if we expressly agree to them.

 

§2 Contracting parties, conclusion of contract, corrections, contract language and storage of contract text

The contract is concluded with Westpark Pharmacy.

The product presentation in the online shop is not a binding offer. You can place products in the shopping cart without obligation and correct your order before submitting it. By clicking on the order button you are making a binding offer. You accept our offer by paying.

For prescription drugs, we require a valid original prescription. This order will only be accepted after the prescription has been checked. Narcotics and items that require refrigeration cannot be ordered.

We reserve the right to reject orders if special information or advice is required. Shipping can also be refused if there is suspicion of misuse. Medicines may not be resold.

 

§3 Delivery conditions/payment

In addition to the product prices, shipping costs apply, which are stated in the offer. Fees and customs duties for shipping outside the EU are borne by the customer. We only deliver by mail, self-collection is not possible.

Payment methods: Prepayment via Stripe or bank transfer. The goods will be shipped after receipt of payment. All prices include VAT, where applicable.

 

§4 Delivery time/packaging

The delivery time within Europe is 3-5 working days for available goods. Worldwide, delivery can take several weeks depending on the destination.

We are not liable for delivery delays caused by unforeseeable events such as strikes. In such cases, we can withdraw from the contract and you cannot assert any claims for damages.

 

§5 Right of withdrawal

Consumers have the statutory right of withdrawal. Entrepreneurs are not granted a voluntary right of withdrawal.

 

§6 Retention of title

The goods remain our property until full payment has been made.

 

§7 Transport damage

In the event of obvious transport damage, we ask consumers to complain to the deliverer immediately and inform us. For entrepreneurs, the risk of accidental loss is transferred to the buyer as soon as we have handed over the goods to the shipping service provider.

 

§8 Warranty and guarantees

The statutory liability for defects applies. For entrepreneurs, the limitation period for claims for defects is one year.

 

§9 Liability

We are liable without limitation for damage caused by us, our legal representatives or vicarious agents, in particular in the event of injury to life, body or health.

 

§10 Dispute resolution

The European Commission offers a platform for online dispute resolution (http://ec.europa.eu/consumers/odr/). We are not obliged and not willing to participate in a dispute resolution procedure before a consumer arbitration board.

 

§11 Protection of minors

If your order includes age-restricted products, we ensure that the buyer has reached the required minimum age.

 

§12 Disposal of electrical and electronic devices and batteries

Electrical devices and batteries must not be disposed of with household waste. We take back old devices and batteries free of charge.

 

§13 Final provisions

For businesses, German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is our registered office in Aachen. The contract remains valid in the remaining parts even if points are ineffective.
